Regulatory Process
The BSSHB transmission line will be constructed in both North Dakota and South Dakota, and the two states have different regulatory processes and timelines. Both states’ processes follow relevant laws and rules, and consider potential impacts on the environment, residents in the routing area, and orderly development of the region. On September 8, 2026, we filed a Facility Permit application with the South Dakota Public Utilities Commission (SD PUC) for the South Dakota portion of the project.
We’ll host a second round of open houses later this year for the northern portion and anticipate filing a Certificate of Public Convenience and Necessity with the North Dakota Public Service Commission (ND PSC) in Q2, 2027.
North Dakota regulatory process
Two key approvals from the ND PSC are needed for this project: a Certificate of Public Convenience and Necessity (CPCN), and a Certificate of Corridor Compatibility and Route Permit. The CPCN process evaluates the need for the proposed facilities. Separately, the project must also receive approval for a Certificate of Corridor Compatibility and Route Permit, which evaluates site specific considerations of the proposed project corridor and route.

South Dakota regulatory process
The South Dakota PUC reviews the project through a Facility Permit application process that evaluates the need for the proposed facility while making sure: (1) the Project complies with all applicable laws and rules; (2) the Project will not pose a serious injury to the environment or the social or economic conditions of inhabitants in the area of the Project; (3) the Project will not substantially impair health, safety or welfare of inhabitants; and (4) the Project will not unduly interfere with the orderly development of the region having been given the views of the governing bodies of the local units of government.
